These general terms and conditions of sale (hereinafter the «T&Cs») govern all transactions carried out on the online platform www.elevatesurf.ch (hereinafter «the Shop»). The Shop reserves the right to amend these T&Cs at its discretion, and the version in force at the time of the order prevails, excluding any unilateral amendment. Any provision contrary to the T&Cs takes effect only with the Shop’s express written acceptance. These T&Cs prevail in all circumstances, even in the absence of express reservations when the service is provided.

Offer and Conclusion of the Contract

The information on items and prices presented in the Shop is intended exclusively for customers residing in Switzerland. The details of the offer are indicative and may be changed by the Shop at any time. By placing an order, the customer makes an offer that the Shop reserves the right to accept or decline. The order confirmation is not an automatic acceptance; the contract takes effect upon shipment of the goods.

Delivery

Deliveries are made exclusively within Switzerland by a carrier appointed by the Shop. Delivery times are indicative and may be adjusted, even after order confirmation.

Payment

Customers may pay by bank transfer. The prices at the time of the order are fixed. Ordering is reserved for persons aged 18 and over.

Retention of Title

Ownership of the delivered items remains with the Shop until the invoice is paid in full. The Shop may enforce this retention of title if necessary.

Complaints / Warranties

The Shop warrants the items against hidden defects for 2 years. Complaints must be submitted within 14 days of receipt. Certain items, such as wear parts, batteries, etc., are not covered by this warranty.

Right of Cancellation and Return

Customers may cancel their order by returning the products within 30 days of receipt. Specific or personalised items are not eligible for return.

Return Procedure

To exercise their right of return, customers must contact the Shop at +41795395358 or info@elevatesurf.ch before returning the items to confirm return eligibility.

Return Conditions

Returned items must be in their original packaging, with labels intact. Unstamped parcels will not be accepted. The customer must keep the customer coupon until the refund is made.

Liability

The Shop excludes all liability for damages related to the use of the Shop or to orders, to the extent permitted by law.

Applicable Law and Jurisdiction

The legal relationships between the customer and www.elevatesurf.ch are governed by Swiss law. Any other law is excluded. The competent jurisdiction for any dispute is Lausanne, with the exclusive jurisdiction of the courts of Lausanne.

Severability Clause

Should certain provisions of the T&Cs be invalid or unforeseen gaps exist, the validity of the remaining provisions remains. The applicable law replaces the invalid or missing provisions.
